  1. Lot research & OER intake: Confirm the (E) on ZoLa, pull prior OER files, and submit the OER hazmat application.
  2. Phase I ESA (ASTM E1527-21): Records review, site reconnaissance, and User Questionnaire targeted at OER's data needs.
  3. Phase II investigation: Soil borings, soil-gas points, and (if applicable) groundwater monitoring wells installed under OER-approved Sampling and Analysis Plan.
  4. Remedial Action Plan + CHASP: OER-format RAP defining excavation, capping, sub-slab depressurization, or vapor barriers; CHASP defining worker protection and community air monitoring.
  5. Field implementation: Licensed remediation under continuous environmental oversight, real-time PID/community air monitoring, and waste characterization.
  6. Closure documentation: Remedial Closure Report and request for Notice of Satisfaction (NOS), the document DOB needs to release your permit and CO.

What is an NYC E-Designation?

An E-Designation is a zoning notation placed on a New York City tax lot by the Department of City Planning during a CEQR-reviewed rezoning to flag potential Hazardous Materials (E-1), Noise (E-2), or Air Quality (E-3) concerns. Once recorded, NYC Department of Environmental Protection's Office of Environmental Remediation (OER) must sign off before any DOB permit is issued for a new building, change of use, or significant horizontal or vertical enlargement.

How do I clear an NYC E-Designation?

OER requires a Hazmat E-Designation Application that typically includes a Phase I ESA, a Phase II subsurface investigation, an OER-approved Remedial Action Plan (RAP) and Construction Health and Safety Plan (CHASP), implementation under OER oversight, and a Remedial Closure Report. OER issues a Notice of Satisfaction (NOS), without it DOB will not release the permit or sign off the CO.

How long does it take to clear an E-Designation?

Straightforward Hazmat (E-1) sites with low contamination can clear in 4–6 months. Sites that require Phase II sampling, RAP negotiation, and field remediation typically run 8–14 months. Build the OER timeline into your permitting schedule, it runs in parallel with DOB filings, not after them.

What is the difference between an E-Designation and a Restrictive Declaration?

Both come from CEQR mitigation, but a Restrictive Declaration is a privately recorded covenant tied to a specific property and project, while an E-Designation is a public zoning notation tied to the tax lot. E-Designations are administered by OER through the NYC Voluntary Cleanup Program-style process; Restrictive Declarations are administered case-by-case with City Planning and the lead agency.

When does an E-Designation trigger a Phase II?

An (E-1) Hazmat designation always requires soil, soil gas, and (where applicable) groundwater sampling unless OER waives it based on prior data. The Phase I ESA establishes the conceptual site model; the Phase II tests it. OER usually requires Phase II results before approving a RAP.

Does an E-Designation transfer with the property?

Yes. The (E) runs with the tax lot until OER issues a Notice of Satisfaction. Buyers should confirm whether prior owners completed OER work and obtained an NOS, an open (E) is a closing-blocking condition for most lenders.
