The Regulatory Landscape in NY & NJ

New Jersey

P.L.2024, c.7 (Structural Integrity Law) requires condominium and cooperative associations with primary load-bearing systems to complete structural integrity inspections and maintain funded reserves for identified capital work. A current reserve study is the standard way to demonstrate compliance.

Associations governed by PREDFDA must also fund adequate reserves under their master deed and bylaws — a reserve study documents what "adequate" means for your property.

New York

While New York does not have a single statewide reserve-study statute, NYC Local Law 11 (facade inspections), Local Law 97 (emissions), and Fannie Mae / Freddie Mac condo project standards effectively require a current reserve study for lender approval and refinancing.

Most co-op and condo boards in NYC, Westchester, and Long Island commission a full reserve study every 3–5 years with annual updates in between.
